Podcast 1 — Introduction & meaning
Narrator: Today's word is Consent — noun and verb, both pronounced kun-SENT, in IPA /kənˈsɛnt/.
Narrator: Consent is one of the most morally and legally significant words in the English language. To consent is to voluntarily agree — to give permission that is freely and knowingly given. The noun consent is that agreement itself.
Narrator: The word came into English in the fourteenth century from the Old French consentir and the Latin consentire — con meaning together, and sentire meaning to feel or sense. Consent is the feeling together — the alignment of two parties' will and intention. The same sentire root gives us sense, sentiment, sentient, consensus, and assent.
Narrator: Informed consent is the cornerstone concept of medical ethics. Before a patient can be treated, they must be given full information about the nature, purpose, risks, and alternatives of the proposed treatment — and then they must freely and competently agree to it. Informed consent protects patient autonomy, reflects the right to bodily self-determination, and prevents paternalistic medicine from simply doing what the doctor thinks best.
Narrator: Sexual consent — the freely and enthusiastically given agreement to sexual activity — is a concept whose legal and ethical clarity has sharpened enormously in recent decades. Legal systems across the world have revised definitions of sexual offences to centre consent more explicitly.
Narrator: In data protection and privacy law, consent is one of the lawful bases for processing personal data under the UK GDPR and GDPR. For consent to be valid, it must be freely given, specific, informed, and unambiguous — and the person consenting must be able to withdraw it at any time.
Narrator: Planning consent and planning permission are synonymous in British administrative law — the authorisation granted by a local authority for development on land.
Narrator: In register, consent is formal in legal, medical, and ethical contexts, and entirely everyday in its general sense of agreement.
Narrator: So remember: consent is where two wills meet — and without it, no authority is legitimate.

Podcast 2 — In conversation
Speaker A: We can't proceed with the data collection without explicit consent from all participants.
Speaker B: Explicit consent — the unambiguous agreement that data protection law requires. Not implied, not assumed, not bundled into a terms of service nobody reads.
Speaker A: The patient consented to the surgery after a thorough discussion with the consultant.
Speaker B: Informed consent to surgery — the process of understanding and agreeing, not just signing a form. The discussion is where the consent actually happens; the form is just the record of it.
Speaker A: They obtained planning consent for the extension quite quickly. The local authority was very helpful.
Speaker B: Planning consent — the administrative permission that makes development legal. It can also be called planning permission. Either phrase refers to the same authorisation from the local planning authority.
Speaker A: People sometimes confuse consent and assent.
Speaker B: Assent is the more intellectual agreement — concurring with a view or proposition. Consent involves will and permission — it authorises action or relationship. Both come from the same Latin root but assent is more cognitive (yes, I agree with that) while consent is more volitional (yes, I permit that to happen).
Speaker A: And don't confuse consent with agreement. Agreement is broad — it covers intellectual, commercial, and relational harmony. Consent is specifically the authorisation of something that would otherwise be impermissible — the permission that the other party needs in order to proceed. Without consent, the action is a violation; with it, it is permitted.
Podcast 3 — Prompt engineering
Speaker B: Scenario one — a GDPR consent prompt.
Design a GDPR-compliant consent management system for a web application. The system must: present consent options granularly (marketing emails, analytics tracking, and personalisation as separate opt-ins), record the exact consent given by each user including version of consent text shown, timestamp, and method of consent (checkbox, button click), allow users to review and withdraw any consent at any time without penalty, and propagate consent withdrawal to all downstream data processors within 72 hours.
Speaker B: Version of consent text shown at time of consent is the legal record that matters if the consent text was later updated — you need to know what the user actually agreed to.
Speaker A: 72-hour propagation of consent withdrawal to downstream processors mirrors the GDPR breach notification timeline and signals the same level of operational urgency.
Speaker B: Next — a medical consent prompt.
Design a digital informed consent workflow for a clinical trials platform. Before a participant is enrolled: they receive the participant information sheet at least 48 hours before consent is requested, a study coordinator answers all questions in a recorded conversation, the participant completes a comprehension check (minimum 80 percent score required for consent to proceed), the consent form is signed digitally with timestamp and IP address, and the consented participant can withdraw consent at any point and must be able to do so without explaining why.
Speaker A: Comprehension check before consent can proceed is the safeguard that distinguishes informed consent from signature collection — you must understand what you are agreeing to.
Speaker B: Right. Now a database schema.
Create a PostgreSQL schema for a consent management platform. Tables: users, consent_items, consent_records, consent_versions, withdrawals. consent_items stores item_name, item_description, and is_required boolean. consent_versions stores consent_item_id, version_number, consent_text, and valid_from timestamptz. consent_records stores user_id, consent_version_id, consented_at, consent_method enum web_form, api, paper_import, and is_active boolean. withdrawals stores consent_record_id, withdrawn_at, withdrawal_reason optional, and withdrawal_propagated_at.
Speaker B: Is_active boolean on consent_records with a matching withdrawals table creates a complete consent lifecycle — granted, active, and withdrawn with full timestamps.
Speaker B: Fourth — a legal education prompt.
Write a 200-word explainer on the legal elements of valid consent for a legal education platform. Cover: the five elements of valid consent (freely given, specific, informed, unambiguous, and from a person with capacity), what defeats each element (coercion defeats free giving, vague wording defeats specificity), the legal concept of capacity to consent including age of consent and mental capacity requirements, and how consent can be withdrawn and what that requires of the party who received it.
Speaker A: What defeats each element of consent is the most practically useful structure — knowing what invalidates consent is as important as knowing what constitutes it.
Speaker B: Fifth — a cookie consent prompt.
Design a cookie consent banner implementation that meets UK ICO guidance. Requirements: the banner must not use dark patterns to steer users toward consent, all categories of cookies must be described in plain English, the reject all option must be as prominent as the accept all option, consent preferences must be saved for 6 months and then renewed, and the site must function fully when cookies are rejected except for strictly necessary cookies. Analytics must not fire before consent is given.
Speaker B: Reject all as prominent as accept all is the ICO's core anti-dark-pattern requirement — equal visual prominence for equal choices.
Speaker B: Sixth — a full small app.
Build a single-page web app called Consent Manager — a personal consent audit tool. User adds the apps and services they use and records: what consents they have given to each, the date given, what they consented to, and whether they still want that consent to be active. For each entry, a review date is set for 12 months. The app highlights consents approaching their review date and provides a one-click link to each service's consent management page if entered. All data in localStorage.
Speaker A: Review date set 12 months forward turns the consent audit into a recurring privacy hygiene practice rather than a one-time activity.
Speaker B: That's the lesson — consent is where two wills meet voluntarily. In data protection, it is a lawful basis with specific requirements. In medicine, it is the ethical foundation of treatment. In law, it is what separates permission from violation. Building consent properly into systems is not just compliance — it is the architecture of trust.
