Podcast 1 — Introduction & meaning
Narrator: Legality. A noun. Pronounced /liːˈɡæl.ɪ.ti/.
Narrator: Legality comes from Medieval Latin legalitas — conformity with the law — from Latin legalis, relating to the law, from lex, legis, meaning law. The -ity suffix forms abstract nouns denoting a state or quality — legality is the state of being legal, as solidity is the state of being solid and clarity the state of being clear. The word has been in English since the seventeenth century as jurisprudence developed the vocabulary needed to discuss and analyse legal concepts.
Narrator: Legality describes whether something conforms to or is permitted by the law. An action has legality if it is sanctioned or at minimum not prohibited by the relevant legal framework. The question of legality — is this legal? — is distinct from the question of morality — is this right? — and the distinction is one of the more significant in jurisprudence and everyday ethics. Many things are legal but morally questionable; some things are illegal but widely regarded as morally justified.
Narrator: The concept of legality varies fundamentally by jurisdiction. Something that has legality in one legal system may be illegal in another. Drug policies, gambling regulations, euthanasia laws, and freedom of expression statutes all produce situations where an identical action is legal in one country and criminal in another. Legality is therefore always relative to a specific legal system and jurisdiction.
Narrator: In international law, legality refers to conformity with the body of international law — treaties, customary international law, and the rulings of international tribunals. The legality of military action, of sanctions, of trade restrictions, is regularly contested in international forums.
Narrator: Legality. The formal relationship between an action and the law — a question entirely separate from whether the action is just, wise, or kind.

Speaker A: Questioning the legality of a government action being one of the most important roles of an independent judiciary.
Speaker B: Judicial review in the UK and constitutional review in the US being the mechanisms by which courts assess the legality of executive and legislative actions. The rule of law depending on this capacity to challenge.
Speaker A: The legality of a business practice being one thing and its reputational consequence being quite another.
Speaker B: The legal but harmful business practice being a recurring issue in corporate ethics. The fact that something is within the law not ending the public's evaluation of whether it should be done.
Speaker A: International humanitarian law and the legality of military actions being an area where legal analysis and political reality are in constant tension.
