Podcast 1 — Introduction & meaning
In any society that relies on contracts, commerce, and agreements between parties who do not always see eye to eye, there must be a mechanism for resolving disagreements without recourse to the full apparatus of the courts. One of the oldest and most important of these mechanisms is arbitration.
Arbitration is a noun, pronounced ar-bih-TRAY-shun, with stress on the third syllable. The IPA is /ˌɑː.bɪˈtreɪ.ʃən/. It is the process by which a dispute between two or more parties is submitted to a neutral third party — the arbitrator — who hears the arguments and evidence and delivers a binding or non-binding decision called an award. Arbitration is a form of alternative dispute resolution, meaning it provides an alternative to litigation in the public court system.
The word derives from the Latin arbitratio, the noun form of arbitrari — to act as an arbiter, to judge. The Latin arbiter originally described a witness or observer who could give an authoritative account. In Roman law, arbitration was formalised as a private dispute resolution mechanism: parties would agree in advance to submit their dispute to a named arbiter rather than to the public praetor. This voluntary submission — the arbitration agreement — is still the foundation of modern arbitration law. You cannot be compelled into arbitration without prior consent.
English commercial arbitration has roots in the medieval guild and merchant systems, where disputes between traders were resolved by senior guild members rather than common law courts. The Arbitration Act 1698 was among the first statutory frameworks for commercial arbitration in England, and successive Arbitration Acts — the current one being the Arbitration Act 1996 — have developed the law into one of the most sophisticated arbitration frameworks in the world. London remains one of the world's top arbitration seats, hosting institutions including the London Court of International Arbitration and the London Maritime Arbitrators Association.
Arbitration has several defining features that distinguish it from both litigation and mediation. It is private — proceedings and awards are not public record. It is final — grounds for court appeal of an arbitration award are very limited. It is expert — parties can choose an arbitrator with specialist knowledge. And it is internationally enforceable — under the New York Convention of 1958, arbitration awards made in signatory states are enforceable in over 170 countries, making international commercial arbitration a cornerstone of global trade.
Arbitration: the quiet room where disputes are settled — privately, finally, and without the theatre of a trial.

Podcast 2 — In conversation
Speaker A: I have been looking at a commercial lease renewal and the landlord's solicitors have included an arbitration clause requiring that any rent review dispute goes to an independent chartered surveyor acting as arbitrator. I had assumed disputes like that would go to the county court.
Speaker B: Rent review arbitration is extremely common in commercial property precisely for the reason your lease reflects — a chartered surveyor acting as arbitrator has the expert knowledge that a court judge may not have. They can assess comparable market rents, evaluate the lease terms, and reach a technically informed decision far more efficiently than a generalist court. The process is also quicker: a court case could take a year or more; a rent review arbitration typically concludes in months. The downside is that the arbitrator's award is binding and the grounds for challenging it in court are very narrow.
Speaker A: I noticed the clause says arbitration rather than expert determination — are those the same thing?
Speaker B: Not quite the same, and the distinction matters. Arbitration is a formal legal process governed by the Arbitration Act: the arbitrator's award is treated like a court judgment and is enforceable as such. Expert determination is a contractual process where a named expert gives a decision, but the mechanism for challenging or enforcing it is contractual rather than statutory. In practice both are binding and both are private, but arbitration has greater procedural formality and the statutory enforcement framework. Many rent review clauses use expert determination rather than arbitration precisely because it is slightly less formal and faster. If the clause specifically says arbitration, you are in the statutory framework.
Speaker A: When people talk about international arbitration versus domestic arbitration, is that just about where the parties are based, or is something else different?
Speaker B: International arbitration typically refers to disputes with a foreign element — parties in different countries, a contract governed by a foreign law, or performance across borders. What makes it particularly significant is the enforcement piece: the New York Convention means an award made in London can be enforced against assets in New York, Singapore, or Dubai through local courts in those jurisdictions. That cross-border enforceability is why international arbitration dominates in global commercial disputes. Domestic arbitration between parties in the same country operates under the same principles but without the international enforcement dimension.
Podcast 3 — Prompt engineering
Speaker B: Arbitration as a domain term in prompt engineering is enormously valuable for legal technology, contract management, and dispute resolution platform development. It carries a very specific procedural vocabulary — arbitration clauses, arbitrators, awards, hearing schedules, evidence submissions, seat of arbitration, enforcement — and when you use it precisely in a prompt, you get outputs that model the correct legal process rather than a generic complaints or dispute workflow. Let me take you through the most practically useful prompt patterns.
Speaker A: Contract management systems that automatically detect and surface arbitration clauses feel like an immediate win — legal teams spend a lot of time doing that manually.
Speaker B: Here is the arbitration clause detection prompt:
Speaker B: PROMPT:
Speaker A: Extracting the seat of arbitration specifically rather than just the existence of the clause — that is the field that determines which national arbitration law governs the proceedings. An arbitration seated in London is governed by the English Arbitration Act 1996; one seated in Paris is governed by French arbitration law. The seat is arguably the most legally significant field in the entire clause.
Speaker B: Now an arbitration case management schema:
Speaker B: PROMPT:
Speaker A: The confidentiality flag on evidence submissions — that is the data governance feature that reflects the fundamentally private nature of arbitration. Unlike court proceedings where documents become public record on filing, arbitration documents are confidential by default in most institutional rules. The flag allows the system to enforce that confidentiality at the access control level.
Speaker B: Now an arbitration award enforcement tracker:
Speaker B: PROMPT:
Speaker A: The set-aside application field per award — that is the defensive intelligence that the enforcement team needs to track in parallel with the enforcement strategy. A debtor who has filed a set-aside application at the seat is attempting to annul the award, which creates a significant risk to the enforcement effort. The dashboard needs to surface that signal immediately.
Speaker B: Now an arbitration clause generator prompt:
Speaker B: PROMPT:
Speaker A: The explanation of each clause element and its legal effect alongside the generated text — that is the educational layer that makes the tool useful for in-house legal teams who need to understand what they are inserting into a contract, not just copy boilerplate. A drafter who understands why the seat matters is far less likely to inadvertently choose an unfavourable jurisdiction.
Speaker B: Use arbitration in prompts whenever you are building legal technology, contract management, or dispute resolution platforms. The word immediately anchors the AI in the correct procedural vocabulary and data structures for a formally governed dispute resolution process — producing outputs that use the right legal terms, the right workflow phases, and the right enforcement framework from the first draft.
